One of Movie Gallery's retail locations (Kilmarnock, VA), which was indicted by a grand jury for public nuisance charges last November 2007, has taken action to remove all XXX Adult themed movies from their stock.
A Lancaster County group last August 2007, lead by Fabiola Gergerich, gathered 94 signatures on a petition to demand that the Circuit Court declare the retail location a public nuisance.

A special grand jury indicted the store last November and according to the Assistant Commonwealth's Attorney J.W. Harmon, "the grand jury found "obscene" adult videos displayed in the back room as well as the packaging of videos and DVD's in the store's main shopping center obscene."
Movie Gallery announced this past February that they were closing an additional 400 unprofitable retail store locations which by the way includes 14 in the state of Virginia.
