ALBERTO TORRICO INTRODUCE PORN TAX BILL TO TRACK PAROLEES

We have confirmed that California State Assemblyman Alberto Torrico, D-Fremont, has just introduced a new bill that would put a new tax on the Gay and Heterosexual Adult Entertainment for products sold in California.

As of today, the proposed tax rate has yet to be determined but sources inside the State Capitol have told JRL that the percentage could be as high as 10%.

Since the bill was first introduced this past Friday, February 27, 2009, it will be sometime before the legislative body has a change to review and determine if the new tax would be a good move for California Adult businesses.

With the economy in the worst shape since the 1940's, how can any assemblyman have the guts to introduce such a bill.

It's no coincidence that the timing of Alberto Torrico's proposal comes on the heals of the assemblyman’s push to provide a domestic abuser surveillance fund to track abusers and stalkers online.

Jeff Barbosa, Communications Director of Media/Communications stated the reason that the rate hasn’t yet been determined was that the bill was submitted at the end of the legislative session on Friday February 27, 2009.

Free Speech Coalition Executive Director Diane Duke blasted the tax proposal Monday afternoon to reporters. "I find it more than a little unfortunate that any of California’s legislators would propose a tax on the already struggling adult entertainment industry," stated Duke. Duke continued to tell reporters... "Our industry is legal, accessed by a broad base of California citizens, already contributes to the California tax base and employs ten of thousands of Californians.

At a time when all businesses, including those in the adult entertainment industry, are fighting to stay afloat imposing a tax such as this is a really bad idea," stated Diane Duke. The bill’s language, as it stands, only includes a proposed tax on the sale of what is considered “harmful goods” and is directed solely at retailersl. Communications Director Barbosa would neither confirm or deny that the bill could also include downloads of Adult Entertainment online.

It will be interesting to see how California handles this bill considering the results that similar bills have attempted to do in proposals raised in Michigan, Georgia, New York, Pennsylvania and Washington state.

If you recall JRL fans, last year California Assemblyman Charles Calderon proposed a 25% excise tax on Gay and Heterosexual adult products, but fortunately it died in committee.
