SUPREME COURT REFUSES TO HEAR ADULT VIDEO STORE CASE

The Supreme Court has refused to get involved in an Indiana town's fight to close Albany Adult DVD store.

The high court on Monday June 7, 2010, refused to hear an appeal from the city of New Albany, Indiana.

City officials have been trying to shut down New Albany DVD,LLC since 2004.

Yes, 6 long years! When Albany Adult Video first tried to open their doors, New Albany's city council adopted a six-month moratorium on new sexually oriented shops. The store's owner turned around and sued the city of New Albany claiming that the city violated his right to free expression.

The 7th U.S. Circuit Court of Appeals in Chicago stated that the city must present clear evidence that the store causes crime or other problems before it can impose restrictions on its operations.

Finally we are seeing the courts stop the unncessary harrassment of business owners who are providing jobs and a service to communities across the country. People who are hung up on their own sexuality need to step back and not impose their own views on other tax paying adults.
